9. Appeals
Chapter 9 sets out the circumstances in which appeals can be made, the grounds on which appeals can be made and the procedures for appealing.
Appeals against requirements to take preventive of remedial measures
9.1 A person required to carry out the preventive or remedial measures specified in Regulations 7(4) and (5) and 9(2) and (3) may appeal to the sheriff (Regulation 10). The time limit may not be extended.
9.2 The requirements appealed against must be complied with pending any appeal, where there is, in the view of the competent authority, an imminent risk to human health or threat of environmental damage, or where the competent authority has previously advised the operator, when requiring the taking of preventive or remedial measures that these must, in any event, be carried out (Regulation 10(7)).
