Costs

25. The key purpose of the Environmental Liability (Prevention and Remediation) (Scotland) Regulations 2008 is to put the sole responsibility on the operator to put right any environmental damage or threat to cause environmental damage through the course of carrying out his activities.

26. An operator must meet the costs of any preventative measures or remedial measures needed to be carried out due to environmental damage or threat of such damage caused by them whilst carrying out their activities. An operator must also meet the costs for any preventative or remedial measures undertaken by a competent authority unless he can demonstrate that the environmental damage or the risk of environmental damage was caused by a third party.
