4 LOCAL DEVELOPMENTS
4.1 As set out in regulation 2 (2) of the draft hierarchy regulations, Local Developments are all developments that have:
- neither been identified as national developments;
- nor fall within the classes described for major developments in the Regulations.
4.2 It is not intended to further split local developments into different classes for the purpose of the hierarchy regulations.
Q4 Do you agree with the definition of local developments?
4.3 The intention is for all aspects of decision making on most local developments to be devolved to local authorities. At present appeals against all types of planning decisions are made to Scottish Ministers. Currently (under the Local Government Act 1973) local authorities are able to delegate to officers a full range of planning decisions, and this will continue to be the case. Under the new planning system certain types of applications for local development will be eligible for inclusion within a scheme of delegation under section 43A of the Planning Act. We envisage elected members will continue to deal with complex or controversial cases. The effect of a case being dealt with under a section 43A scheme of delegation is that the where the applicant requests a review of a decision taken under such a scheme, it will be to a local review body rather than to Scottish Ministers. This is in line with the principle that decisions on local matters should be made locally. Further details of our proposals for local review bodies will be set out in a separate consultation on appeals.
