16. Developers should note that where a structure erected under Class 72A does not comply with the limitations ( e.g. area of ground covered, maximum height) and conditions ( e.g. notification of the planning authority, removal of structures) set out in the Order and described above, then there is the risk of enforcement action. This could also arise where development was undertaken outside the declared zone or was not used to house birds to protect them from avian flu. This could lead to prosecution and fines or to the planning authority entering the land, carrying out the necessary works and charging the costs to those responsible for the breach of planning control.
