Requirement for Planning Permission

14. Where site operators are planning permanent works or operations which do not comply with these or other permitted development rights, then an application for planning permission to the planning authority will be required. There is also the possibility that, depending on the location of the farm or facility and the exact nature of the development, mechanisms for environmental impact assessment under the Environmental Impact Assessment (Scotland) Regulations 1999 or for appropriate assessment under the Conservation (Habitats &c.) Regulations 1994 may come into play and may require a planning application to be made.
