Other Limitations on the Planning Permission
8. The temporary planning permission granted by Class 72A(1) would not apply in the following circumstances:
The development would affect a listed building or its setting;
- the height of the building erected or the building as extended or altered would exceed 12 metres;
- where the development is within three kilometres of an aerodrome, the height of the building erected or the building as extended or altered would exceed 3 metres;
- the area of ground which would be covered by the building erected or the building as extended or altered would exceed 465 square metres;
- where development is carried out on the same farm or facility more than once by virtue of this class, the aggregate of the area of the ground covered by any such development would exceed 465 square metres;
- where the development consists of the extension of a building, the area of ground which would be covered by the building as extended would exceed the area of ground covered by the existing building by more than 50 per cent.
9. There is therefore an overall limit of 465 square metres on the ground area on each farm or other facility with poultry or captive birds which can be covered by development under Class 72A. That limit may be made up of temporary stand alone buildings or temporary extensions to existing buildings. In the latter case there is an additional constraint that extensions can cover an area of ground no greater in size than half that of the original building.
