Temporary Planning Permission
4. Class 72A(1) grants temporary planning permission for the erection, extension or alteration of a building where that is necessary for the purpose of housing poultry or other captive birds to protect them from avian influenza.
5. This necessity would arise where the Scottish Ministers have declared a zone or zones within which the housing of birds is required. The zones will be named as required by the relevant disease control legislation, ie Protection Zone, Surveillance Zone, Avian Influenza Restricted Zone, Low Pathogenic Avian Influenza Restricted Zone, Avian Influenza Prevention Zone, Wild Bird Control Area, Wild Bird Monitoring Area. In declaring such a zone detailed maps showing the extent of the zone and information on the requirements for the protection of birds will be issued by the Scottish Executive Rural Directorate ( SERD) and will be available on their website http://www.scotland.gov.uk/Topics/Agriculture/animal-welfare as well as at SERD's offices at Pentland House, 47, Robb's Loan, Edinburgh, EH14 1TY.
6. In certain circumstances, housing of birds will also be required on specific premises and this will be specified on the restriction notice served on the premises.
7. The planning permission granted by Class 72A(1) will last only until 26 March 2008 or, if earlier, the date when the buildings are no longer needed to protect birds from avian influenza, typically this will be the date on which the Scottish Ministers either revoke a zone by declaration, or amend requirements associated with a zone, again by declaration, so that housing is no longer needed 1, whichever of these is the sooner. The structures erected will need to be removed on or before the relevant date.
