Introduction

1. This document explains the provisions of the Town and Country Planning (General Permitted Development) (Avian Influenza) (Scotland) Amendment Order 2007 ( SSI 2007/ 135) which came into force on 26 March 2007.

2. The purpose of the Order is to amend The Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (the GPDO) to grant a temporary planning permission for development to address the housing of poultry and other captive birds in the event of an outbreak of avian influenza in Scotland.

3. The Order introduces a new Part 25A and Class 72A in this regard to Schedule 1 to the GPDO. This removes the need to apply for planning permission or prior approval for temporary structures required in this regard. There are, however, certain conditions and limitations associated with this planning permission and these are described in the following paragraphs.
