THE LOCAL AUTHORITIES' TRAFFIC REGULATION ORDER (PROCEDURES) ( SCOTLAND ) REGULATIONS 1999
The Local Authorities' Traffic Regulation Order (Procedures) (Scotland) Regulations 1999 (the Regulations) replaced, after consultation, previous Regulations which had been in force since 1987. The decision to revise the Regulations was based on a desire to make the procedures associated with traffic regulation orders (TROs) more efficient and easier for local road authorities while at the same time safeguarding the interests of road users and the public at large.
As part of a continuing review of all legislation, further improvements to this legislation have been proposed and the purpose of this letter is to invite comments on draft amendment regulations (attached).
Regulation 8 of the Regulations currently imposes a requirement on a local authority promoting a TRO to hold a hearing in certain circumstances, for example the prohibition of loading or unloading of vehicles at all times or requiring vehicles to travel in a particular direction. Where the TRO is required to implement a particular project which has, for whatever reason, previously been the subject of Parliamentary scrutiny, we consider this provision to be somewhat onerous and our intention is to amend the Regulations accordingly.
