BREACH OF ELECTRONIC MONITORING AS A CONDITION OF A PROBATION ORDER

Summary

1. I am writing to you to provide clarification on the procedure for dealing with breaches of an electronic monitoring condition of a probation order.

Background

2. Justice Department Circular 2/2004 detailed the agreed procedures for the streamlining of breach processes through the courts. A copy of the circular is attached at Annex A for ease of information community.

3. Although the circular explains how breaches of an electronic monitoring condition attached to a probation order should be dealt with, we are aware of some confusion in social work departments as to the exact process to be followed and what constitutes a breach of the electronic monitoring condition. This circular therefore supplements and clarifies the agreed procedure laid down in Circular 2/2004
