INTRODUCTION

In November 2006 we launched a consultation on proposals for improving Education Appeal Committees (EACs). In addition to the full consultation paper a summary version was also produced, focussed on the main proposals and broad questions on the EAC system.

EACs hear appeals from parents (and young people in certain circumstances) against a local authority's decision to refuse a placing request, or to exclude a child from school. Local authorities establish EACs, with members drawn from a pool that includes parents, those with knowledge of education, councillors, and others. In 2004/05 EACs heard almost 400 appeals. Of cases where EACs had made a decision when statistics where collected, 22% were successful.

The consultation paper followed a critical report on EACs in 2000 by the Scottish Committee of the Council on Tribunals, and research, commissioned by the Executive, on the experiences of parents who had appealed to EACs. The consultation outlined the Scottish Executive's proposals to improve the EAC system, and asked for views on the proposals and on the EAC system generally.
