Annex D: Outline of key steps involved in establishing a National Park

Statutory processes

Should Ministers decide, in the light of this consultation, to develop a proposal to designate a Coastal and Marine National Park, the following framework for establishing a National Park contained in the National Parks (Scotland) Act 2000 would then be followed:

Notes:
Individuals and organisations include: public agencies, local authorities, community councils, voluntary bodies and those individuals and organisations who are representative of those who work or carry out business in the area to which the proposal relates. Special provisions are contained in the National Parks (Scotland) Act 2000 to ensure that fishing interests have the opportunity to input effectively to this process.

At Step 1, Scottish Ministers may choose to undertake the consultation on the proposal themselves rather than appoint a Reporter.

At Step 4 the need for a PLI is determined solely by Scottish Ministers. At Step 10, the precise composition of the Board of a National Park Authority will vary according to the approach set out in the Designation Order.
