PART II EVALUATING CHAPTER 43: QUANTITATIVE ANALYSES
Chapter 43 was designed to achieve two main goals: to reduce delay amongst personal injury actions proceeding in the Court of Session and to reduce inconvenience to the court and court users by bringing settlement forward from the day of the proof or trial, or from the days immediately preceding it.
This section relies on quantitative data collected specifically for the research project, as well as information compiled by the designated PI clerk in the Court of Session, to address the following research aims:
- To assess the impact of Chapter 43 on reducing delay in the Court of Session
- To assess the impact of Chapter 43 on bringing forward the date of settlement from the diet of proof/trial
- To assess the impact of Chapter 43 on court business
Part II is divided into four chapters. It begins with a short chapter that monitors the use of Chapter 43 in the Court of Session as well as remittal from the new procedure to the Ordinary Roll. The subsequent three chapters address the three main criteria by which Chapter 43 is evaluated in this report, as listed above.
