FORM OF TENDER TO THE SCOTTISH EXECUTIVE

*I/We the undersigned do hereby contract and agree on the acceptance of the Tender by the Scottish Ministers, to provide the services in the Service Specification in accordance with this ITT, at the prices entered in the Costed Bid and in accordance with the draft Contracts contained in the Information Room.
*I/We the undersigned undertake to submit a Tender in accordance with the following documents:
- Notices and Instructions ( Section 2);
- Service Specification ( Section 3);
- Content of the Technical Submission ( Section 4);
- Content of the Costed Bid ( Section 5);
- Form of Tender to the Scottish Executive ( Section 6); and
- Statement of Understanding of Key Requirements of the Service Specification ( Section 7).
*I/We agree to abide by this tender from 3 p.m. on 11 May 2007 the date fixed for receiving tenders, until the award of the PSC.
*I/We understand that the Scottish Ministers are not bound to accept the lowest or any tender and shall not be bound to use the Successful Tenderer as a sole supplier.
*I/We understand that it is intended that the service provision will commence on 1 October 2007.
It must be clearly shown whether the Tenderer is a limited liability company, statutory corporation, partnership, or single individual trading under his own name.
