TRANSPORT ( SCOTLAND ) ACT 2005: CONSULTATION ON ROAD WORKS REGULATIONS AND CODE OF PRACTICE - PART 2: PENALTIES, DISPUTES & APPEALS, REGISTER FEES & AMOUNTS AND QUALIFICATIONS

Since the Transport (Scotland) Act 2005 came into force in August 2005, we have been working closely with road works authorities and statutory undertakers to develop the Regulations (secondary legislation) and Codes of Practice that will give effect to the road works provisions of the 2005 Act. These are aimed at improving the planning, co-ordination and quality of road works throughout Scotland.

We now wish to consult on the element of the secondary legislation relating to penalties, disputes & appeals, register fees & amounts and qualifications. The following draft documents are available on the Scottish Executive website at www.scotland.gov.uk , and we would very much welcome your views either in general terms or on specific points of detail:

  • The Road Works Code of Practice for Penalties;
  • The Road Works (Fixed Penalty) (Scotland) Regulations 2007;
  • The Roads (Scotland) Act 1984 (Fixed Penalty) Regulations 2007;
  • The Scottish Road Works Commissioner (Imposition of Penalties) Regulations 2007;
  • The Road Works Code of Practice for Dispute Resolution and Appeals;
  • The Road Works (Settlement of Disputes and Appeals against Directions) (Scotland) Regulations 2007;
  • The Scottish Road Works Register (Prescribed Fees and Amounts) Regulations 2007; and
  • The Road Works (Qualifications of Supervisors and Operatives) (Scotland) Regulations 2007.

The Penalties and Dispute Resolution & Appeals Code of Practice have been drafted by a working group drawn from the Roads Authorities & Utilities Committee (Scotland), to whom we are most grateful for their time, effort and commitment in producing these documents. We anticipate consulting on resurfacing during 2007.

Please note that the closing date for responses is 18 December 2006, and we look forward to receiving your views.
