1. Introduction

1. The draft regulations set out in this document have all been prepared in accordance with the relevant sections of the Licensing (Scotland) Act 2005 under which the authorisation is provided for the making of such regulations. The regulations should be read alongside the relevant sections of the Act to provide the reader with better picture of what they seek to achieve.

2. In order to assist the development of these regulations, Ministers are keen to ensure that those with a direct interest in the secondary legislation prepared under the Act can feed into the process. In order to facilitate this we are now seeking comments on a draft of the proposed regulations. Before coming into force all the draft regulations must be laid before Parliament for approval. It is expected that following this consultation and any subsequent amendments to the regulations deemed necessary by Ministers in light of comments received, the regulations will be laid before Parliament in February 2007.
