TRANSPORT ( SCOTLAND ) ACT 2005

CONSULTATION ON ROAD WORKS REGULATIONS AND CODE OF PRACTICE

Since the Transport (Scotland) Act 2005 came into force in August 2005, we have been working closely with road works authorities and statutory undertakers to develop the Regulations (secondary legislation) and Codes of Practice that will give effect to the road works provisions of the 2005 Act. These are aimed at improving the planning, co-ordination and quality of road works throughout Scotland.

We now wish to consult on the core element of the secondary legislation relating to co-ordination and planning. The following two draft documents are available on the Scottish Executive website http://www.scotland.gov.uk/Consultations/Current/Q/rowId/0#conRow0, and we would very much welcome your views either in general terms or on specific points of detail:

  • The Road Works (Scottish Road Works Register, Notices, Directions and Designations) (Scotland) Regulations 2007.
  • The Co-ordination Code of Practice.

The Co-ordination Code of Practice has been drafted by a working group drawn from the Roads Authorities & Utilities Committee (Scotland), to whom we are most grateful for their time, effort and commitment in producing this document. We will be issuing further draft documents on penalties, dispute resolution & appeals and training soon and we anticipate consulting on resurfacing during 2007.

This is a web-based consultation and you may respond electronically as instructed on the website if you wish. Please note that the closing date for responses is 30 October, and we look forward to receiving your views.
