12. Scottish public authorities should be aware that information that is disclosed under the EISRs might be subject to copyright protection. If an applicant wishes to use any such information in a way that would infringe copyright, for example by making multiple copies, or issuing copies to the public, he or she would require a licence from the copyright holder. See also the Guidance on Implementation of the EISRs.

13. Reports on the environment may be commissioned by Scottish public authorities from outside organisations. In general, Scottish public authorities should seek to ensure that the copyright of any such reports rests with them. If not, it should be made clear to the outside organisation that, under the terms of the EISRs, the Scottish public authority may be obliged to make copies of their reports, or parts thereof, available to the public in response to EISRs applications.

14. Authorities should also be aware that the Re-use of Public Sector Information Regulations 2005, while not affecting copyright, do provide a framework for public authorities to charge for the re-use of information for which they are the copyright holder.
