Summary of Proposals
10. The following is a summary of the legislative amendments that the Scottish Executive intends to introduce. Greater detail and context is supplied in the relevant paragraphs from page 8 onwards.
Powers to prevent, discourage and rectify damage to protected species
- Prohibition of the keeping, transport and sale or exchange, of specimens listed under Annex IV of the Habitats Directive (when taken from the wild, except for those taken legally before the Directive was implemented, or those allowed or licensed under the amended Habitat Regulations)
- Removal of the so-called "Incidental Results" and "Compassionate Action" defences
- Further legislate against indiscriminate capture and killing
- Make a technical amendment to the Conservation of Seals Act 1970 to ensure compliance with the requirements of the Habitats Directive
Development Plans
- Apply the appropriate assessment requirements to local authority structure plans and local plans as provided for in Part II of the Town and Country Planning (Scotland) Act 1997
Water Abstraction
- Transpose Article 6(3) and (4) of the Habitats Directive as regards water abstraction plans and projects
Surveillance and Monitoring
- Transpose the surveillance obligations set out in Articles 11 and 14(2) of the Habitats Directive
- Transpose the monitoring obligations set out under Article 12(4) of the Habitats Directive
