Part 1: Publicly Funded Legal Assistance on Civil Matters

The consultation document defined the term "publicly funded legal assistance ( PFLA)" on civil matters as meaning advice on justiciable problems - that is, advice on matters which raise a legal issue or which, if not resolved earlier, could result in legal action being taken.

Legal advice was defined for the purposes of the consultation paper as including information and advice about the law and alternative means of resolving legal problems, help in preventing or resolving disputes about legal rights and obligations, and help in enforcing decisions. This included advice on rights and responsibilities, on resolutions and remedies and could be provided by agencies other than lawyers. Crucially, the paper stressed that for the purposes of the consultation, "legal" advice should be seen as advice on the law, but not necessarily formal legal advice in the usual sense.
