Consolidation of the Seeds (Registration, Licensing and Enforcement) Regulations 1985
I am writing to advise you of the consolidation of the Seeds (Registration, Licensing and Enforcement) Regulations 1985 (RLEs) that are currently being drafted by SEERAD. The consultation document (Annex) provides details of the main changes which we propose to introduce in the Seeds (Registration, Licensing and Enforcement) (Scotland) Regulations 2006. These cover:
- The impact of Council Directive 2004/117/ EC, which formalises the scheme for an experiment
- Registration of Seed Merchants, Seed Processors or Seed Packers
- Licensed Crop Inspectors and Licensed Seed Samplers
- Licensed Seed Testing Stations
- Representations
- Appeals
- Record Keeping
- Transitional Arrangements for Licences
The attached Annex describes the proposed changes in detail.
This consolidation exercise will allow us to update requirements brought about by Council Directive 2004/117/ EC, most of which we already take account of in either the RLEs, the seed marketing regulations or by way of our General Licence on Equivalence - General Licence No. 2005/2.
Part of this exercise will include the revision of licences issued to crop inspectors, seed samplers and seed testing stations. The Annex provides details of the principal changes to the licences. The proposed wording for the new licence conditions has not yet been finalised at the time of issuing this letter but we will consult on those, not later than the 24th March 2006. However, it is important to note that the consultation will be the opportunity to comment on the proposed new licence conditions. After that, the conditions will be finalised and existing licences varied without further opportunity for representations. There will be no opportunity to vary licences until 3 months after the 2006 RLEs have come into force (likely to be 1 July 2006) to allow transitional arrangements to be effected ( eg variations related to crop inspectors varying the species and/or category of the crops they are qualified to inspect or seed samplers varying the functions of their licence).
Although this is a fairly lengthy consultation document, you should note that a lot of the proposed changes are currently part of the licences and we are simply providing clarification and transparency in the legislation.
