The Town and Country Planning (Planning Authority Marine Boundaries) (Scotland) Order 2006

The Scottish Ministers in exercise of the powers conferred by sections 24(5) and (6) of the Water Environment and Water Services (Scotland) Act 2003( a), and of all other powers enabling them in that behalf, and after consulting the Scottish Environmental Protection Agency, every planning authority and other persons as they think fit in accordance with section 24(7) of that Act hereby make the following Order, a draft of which has been laid before and approved by the Scottish Parliament:
Citation, commencement and extent
1.-This Order may be cited as the Town and Country Planning (Planning Authority Marine Boundaries) (Scotland) Regulations 2006 and shall come into force on [XX].
Interpretation
2.-In this Order, unless the context otherwise requires-
"the 1997 Act" means the Town and Country Planning (Scotland) Act 1997( b);
"deposited map" means the map "The Town and Country Planning (Planning Authority Marine Boundaries) (Scotland) Order 2006" and the related information recorded on the CD-Rom, one copy of which is deposited in the office of the Scottish Executive, Victoria Quay, Edinburgh, and another copy deposited in the relevant offices;
"operations" means development within the meaning of section 26(6) of the 1997 Act;
"planning authority" has the same meaning as section 1 of the 1997 Act;
"relevant offices" means in relation to a planning authority its the principal office.
Designation of planning authority boundaries
3.-The planning authority specified in Column 1 of the Table in the Schedule to this Order is to be the planning authority for the purposes of the application of the 1997 Act by virtue of section 24 of the Water Environment and Water Services (Scotland) Act 2003 Act to operations in the areas of transitional water or coastal water on the deposited map and described in Column 2.
