5 In subsequent guidance the Commission has made clear that mainland to mainland routes may also be included where the alternative road journey is at least 100 kilometres and is 10 times longer or more than the sea crossing.

14 For a subsidy to be classified as a state aid, it must fulfil four criteria:
a) there must be intervention by the State or through State resources;
b) the intervention must be liable to affect trade between Member States;
c) it must confer advantage on the recipient; and
it must distort or threaten to distort competition.
