Summary
A number of the shortcomings of the PO system could be addressed by changes to the primary
legislation as described above. These
include:
- Removal of the need for applicants to advertise in
the Edinburgh Gazette;
- Legal requirement for an independently chaired
Consultative Committee;
- Exclusion from application of fisheries that do not
want to be included/removal of those who do not
comply;
- Legal requirement for a Monitoring and Reporting
Committee;
- Clearer definition "significant increase in
availability of fishing";
- Requirement for existence of a PO to be observed
when property changes hands;
- Legal protection for commercial and club fisheries
which are already fully available to anglers.
Others might be addressed by administrative
mechanisms. These include:
- Review of the application
process, including provision of an electronic service
for application;
- Greater publicity for the fact
that POs cover all freshwater fish species;
- Better publicity of and
arrangements for issue of permits;
- Definition of "public loch";
- Codes of practice to address
problems with resource sharing.
Some of these issues may be addressed in the
forthcoming Bill, while others will necessarily have to
wait until the appropriate management structures have
been established.
