GUIDANCE ON PARENTING ORDERS

I enclose a copy of the guidance on parenting orders which will underpin the 3 year national pilot on parenting orders.

As set out in the Antisocial Behaviour etc. (Scotland) Act 2004 (Commencement and Savings) Order 2004, measures in Part 9 of the 2004 Act come into force on 4 April 2005 which will allow parenting orders to be applied for. The relevant sections of the 2004 Act are s102 - s117.

The Executive consulted between January and March 2005 on the enclosed guidance designed to help those who will be working with the new measures, primarily, reporters, local authorities and children's panel members. This guidance has been revised in the light of comments received and is also available on the Scottish Executive website: http://www.scotland.gov.uk/Publications/Recent

The guidance makes clear that parenting orders are about the behaviour of parents and getting them to change their behaviour in respect of their child, and to take responsibility. The new measure is only appropriate for those parents who have refused to engage with voluntary support services where poor parenting has been identified as an issue.

An analysis report outlining the main themes from the consultation responses received will also be made available shortly on the Executive website.
