EFFORT CONTROL MEASURES 2005: GUIDANCE NOTES

INTRODUCTION

1. At the Agriculture and Fisheries Council in December 2004, agreement was reached on further effort controls to apply to vessels of 10 metres or over in the North Sea, Skagerrak, Kattegat, West of Scotland, Irish Sea and Eastern Channel as part of the measures introduced predominantly for the recovery of cod stocks. In addition, new effort controls were introduced in the Western Channel for the recovery of sole stocks.

2. The measures apply from 1 February 2005 and are founded on obligations contained in Annexes IVa and IVc of Council Regulation (EC) No. 27/2005 and Council Regulation (EC) No. 423/2004. They replace the previous arrangements introduced in February 2004 under Annex V of Council Regulation (EC) No. 2287/2003.

3. You will already have received a letter providing initial advice on the implications of the new effort management arrangements. These notes provide further, more comprehensive guidance to masters and owners of UK fishing vessels which operate in the waters covered by the Cod Recovery Zone or 'CRZ' and the Western Channel. They are not exhaustive nor should they be regarded as a definitive statement of the law. They should be read in conjunction with:

  • Council Regulations (EC) No. 27/2005, and No. 423/2004; and
  • the relevant national legislation - in Scotland, SI No. 90/2005 The Sea Fishing (Restriction on Days at Sea) (Scotland) Order 2005.
