APPENDIX 3: Form of Community Service Order

Criminal Procedure (Scotland) Act 1995

Community Service by Offenders

Order of Court

19 the Court, in respect of the said Offender who resides/is to reside in the area of has been convicted of the said offence(s), Required the said authority to appoint or assign an Officer to discharge the functions assigned to him by the aforesaid Act in respect of the said Offender and to notify the said Offender forthwith of the name and address of the Officer; and Ordered that the said Offender shall, during the period of twelve months from this date or until the performance of the hours of unpaid work specified at (2) below, whichever is shorter.

(1)report to the officer appointed or assigned to him as before required and notify the said Officer without delay of any change of address or of any change in the times, if any, at which he/she usually works and

(2)perform for hours such unpaid work at such times as the said Officer may instruct.

If for any reason the Offender fails to perform the unpaid work specified in paragraph (2) above during the period of twelve months from the date of the Order:

(a)the Order shall remain in force beyond the twelve month period;

(b)the Offender's obligation under paragraph (1) above will continue; and

(c)the Local Authority Officer appointed under the Order shall take whatever action is appropriate to bring the circumstances to the attention of the Court.

RECEIPT OF ORDER

a.I have been given, read and understood the foregoing Order.

b.I understand that the court, if satisfied that I have failed to comply with any of the conditions of this order, may take the following action under section 239 of the Criminal Procedure (Scotland) Act 1995.

i.Continue the Order and impose a fine (not exceeding level 4 in the standard scale of fines); or

ii.Revoke the Order and impose any penalty the Court could have imposed at first instance; or

iii.Vary the number of hours in the Order (but not in total less than 40 hours nor more than 240 hours).
