Consultation on Draft Guidance to Local Authorities and National Park Authorities
SUMMARY OF RESPONSES

Introduction

The twelve-week consultation on the draft guidance for local authorities and national park authorities was launched on the 16 February 2004 and closed on Friday 7 May 2004.

The consultation document was distributed to all 32 local authorities and the two national park authorities in Scotland. It was also circulated to the members of the Access Forum. The draft guidance was also placed on the SE Website and a number of individuals and organisations responded through that way. Whilst section 27 of the Land Reform (Scotland) Act 2003 only requires that Ministers consult with local authorities and national park authorities, the Executive welcomes all those who chose to respond. 75 responses were received - from 27 of the local authorities, from COSLA, one from each of the two national park authorities in Scotland and the remainder from individuals and other interested organisations. All the responses received have been considered and are included in this analysis of the consultation.

Following the consultation, the draft guidance was amended in light of comments received and it was submitted to Ministers for their approval. A brief summary of these amendments is set out in section 2 of this report.

In accordance with section 27 of the Act, the draft guidance was laid before the Scottish Parliament in early December 2004. Following the Parliamentary process, if the Parliament resolves that the guidance should be issued, it will be distributed to all 32 local authorities and the two national park authorities in Scotland and they must, as set out in section 27 of the Act, then have regard to such guidance.

This report on the consultation provides a summary of the main issues raised by those who responded. A copy of this Summary Report is available on the Scottish Executive's website publications web pages.
