Scottish Executive and STUC Memorandum of Understanding: Paper on Fair Employment Practice and Effective Trade Unionism

INTRODUCTION

The Memorandum of Understanding (MoU), signed in April 2002, formalises engagement between Ministers and the STUC across a wide range of public policy issues. The MoU commits the Executive to 'support as far as practicable, effective trade unionism, fair employment practice, and greater partnership between employers and trade unions'.

The Scottish Executive aims to be a best practice employer and there is a range of Executive activity and policy to promote and support fair employment practices. To build on this, the Permanent Secretary agreed to undertake a stock-take of these activities and identify other areas where the Executive could promote these principles.

This stock take was undertaken in March 2004. The attached paper draws together the key activities identified and includes fair employment practices in the Scottish Executive itself, guidance issued by the Executive on fair employment practice and examples of fair employment practice in Non-Departmental Public Bodies - drawn from a diversity of areas including the NHS, Communities Scotland and the Scottish Prison Service.

The paper is in four parts:

  • Section One: highlighting what the Executive itself does as a fair employer;
  • Section Two: examples of where the Executive issues guidance on fair employment practices;
  • Section Three: examples of fair employment practice in the Executive's Non-Departmental Public Bodies.
  • Annex A: Case studies from the Development Department; Environment and Rural Affairs Department and the Enterprise, Transport and Lifelong Learning Department.

This is not an exhaustive list. It is, however, a snapshot of the type of activity which the Executive does, and encourages others to do, to meet its commitment to fair employment practice. The paper also recognises the influence of trade unions in encouraging fair employment practice both in the Executive and in organisations and workplaces across Scotland.
