43. It is likely that statutory Producer Responsibility for non-packaging farm plastics waste will be more expensive for industry than a voluntary scheme. A statutory scheme will include administrative overheads such as Agency registration, monitoring and enforcement and their costs will need to be covered by related fees and charges. The accompanying Initial Regulatory Impact Assessment contains a fuller discussion of the potential costs of a producer responsibility scheme. Industry would also, under any system, have to establish systems of record keeping to demonstrate compliance. It is not proposed to require individual producers to provide data, but some data on the amount of farm plastics waste arising (or a protocol developed relating sales to waste) and on the amount of recovery and recycling will be needed. If compliance schemes were set up, and the large majority of producers were to join, the costs are, however, likely to be lower given the economies of scale that would be possible.
