A REPORT BY THE TASK GROUP SET UP TO REVIEW THE LICENSING PROVISIONS CONTAINED IN THE CIVIC GOVERNMENT (SCOTLAND) ACT 1982
FOREWORD
1. Following consideration of a report by the Convention of Scottish Local Authorities (COSLA), Scottish Ministers determined that a review of the licensing provisions contained in the Civic Government (Scotland) Act 1982 (the 1982 Act) should be carried out and set up a Task Group for this purpose.
2. The Task Group's remit was "to re-examine the principles and mechanisms of licensing as they are set out in the 1982 Act and, having done so, review the existing provisions and any proposals for change submitted to the Executive". In doing so, the Task Group was required to ensure that the provisions of the Act, and any recommendations for change, were compliant with the European Convention on Human Rights (ECHR) and that they properly apply the principles of the Scottish Executive's Enforcement Concordat which provides for fair, practical and consistent enforcement policy and practice.
3. The Task Group comprised:-
Leslie Evans, Chair and Head of Public Service Reform Group within the Scottish Executive;
Chief Superintendent Ken Bellingham, Deputy Chief Constable Ken McInnes, and Chief Superintendent John McNab, all Fife Constabulary, representing the Association of Chief Police Officers in Scotland (ACPOS) at different stages of the review;
Stefano Boni and Niall Stewart, representing the Federation of Small Businesses at different stages of the review;
Ann Callaghan, Head of Civic Governance Team within Local Government Constitution & Funding Division, Public Service Reform Group, the Scottish Executive;
Alex Gibson, Civic Governance Team, Scottish Executive;
Anil Gupta, COSLA;
David Hume, Chief Executive, Scottish Borders Council, representing the Society of Local Authority Chief Executives (SOLACE);
Mitch Kerr, North Lanarkshire Council, representing COSLA;
Jim Matthew, Angus Council, representing COSLA;
Robert Millar, City of Edinburgh Council, representing the Society of Local Authority Lawyers and Administrators in Scotland (SOLAR);
Alisdair Meldrum, formerly Branch Head, Business Environment and Consumer Affairs Division within the Scottish Executive;
Alan Oliver and Jacqueline Conlan, Head of the Licensing (Liquor and Gambling) Team within Public Service Reform Group, the Scottish Executive at different stages of the review; and
John Sharratt, Scottish Borders Council, representing the Society of Chief Officers of Trading Standards in Scotland (SCOTSS).
4. The Task Group consulted widely on its preliminary findings between July and October 2002. Our conclusions and recommendations are contained in Chapters 1-16 of the Report and for ease of reference we have also provided a summary of those recommendations at the front of our Report.
