Controlled Activities Regulations

PURPOSE

This is the second in a series of consultation papers which we plan to issue about our detailed proposals for the implementation of the requirements of Water Environment and Water Services (Scotland) Act 2003 (the WEWS Act). The first, "River Basin Districts - Proposals for Scotland", was published on 2 September 2003 and the subsequent designation of river basin districts took place last December.

The WEWS Act established a broad framework for the future management of our rivers, lochs, coasts and groundwater. Under the Act we are required to introduce secondary legislation on a range of issues, and we propose to consult on those issues during the course of the coming months.

This paper focuses on 3 key aspects of implementation:

  • the introduction of controls over activities affecting the water environment;
  • transitional arrangements; and
  • links with existing environmental legislation.

Comments on the proposals should reach us at the address below by Friday 9 July. Thereafter we hope to lay the Regulations in the Scottish Parliament in the autumn of 2004.
