5.0 DEFINITION OF DEVELOPMENT

Proposal: All water abstractions and land drainage schemes for agricultural purposes should be brought within the definition of 'development'.

Present position: 'Water management projects for agriculture' are listed amongst those projects that may require to be subject to environmental assessment. However, unless such projects include activities which constitute 'development', they will fall outwith planning control. Including them within the definition of development will bring them within control, although most such activity would be permitted under the General Permitted Development Order (classes 18 or 20) unless it required an environmental assessment.

Implementation: This would require an amendment to the definition of 'development' in s.26 of the 1997 Act.

Discussion:

  • It seems strange to propose the inclusion of these activities within the scope of development control, when the bulk of agricultural and forestry activity will remain outwith the planning system.
