THE SCHOOL CROSSING PATROL SIGN (SCOTLAND) REGULATIONS 2002

Regulation 39(1), in conjunction with Diagram 605.2 of the Traffic Signs Regulations and General Directions 1994 (The TSRGD) currently prescribes the size, colour and type of sign which, in accordance with section 28 of the Road Traffic Regulation Act 1984, a school crossing patrol may exhibit so as to require traffic to stop when approaching a place where a person is crossing or seeking to cross a road. These Regulations, which are reserved, are currently being revised and a new version is expected later in the year. Legal advice is that the school crossing patrol sign is not a road sign and as such, will not be included in the revised TSRGD.

Accordingly, new regulations which will be required when the current TSRGD is revoked and the purpose of this letter is to seek your views on these enclosed draft regulations.

You are invited to send your comments on these draft regulations to me at the above address no later than 31 October. While I appreciate this only allows little more than six weeks for a response, your co-operation in meeting this deadline would be appreciated. It will be assumed that you are content with the draft as it stands if we receive no response to this letter.

The School Crossing Patrol Sign (Scotland) Regulations 2002

The Scottish Ministers, in exercise of the powers conferred by section 28(4) of the Road Traffic Regulation Act 1984() and of all other powers enabling them in that behalf, and after consultation with representative bodies in accordance with section 134(2) of that Act, hereby make the following Regulations:

Citation and commencement

1.-(1) These Regulations may be cited as the School Crossing Patrol Sign (Scotland) Regulations 2002 and shall come into force on 2002.

Interpretation

2. In these Regulations-

(a) "patrol sign" means a sign exhibited by a school crossing patrol for the purpose of stopping a vehicle in accordance with section 28(1) of the Road Traffic Regulation Act 1984;

(b) "perimeter strip" has the meaning given by regulation 3(3);

(c) "the pole" means the pole comprised in a patrol sign;

(d) "retroreflecting material" means material which reflects a ray of light back towards the source of that light; and

(e) "the roundel" means the roundel comprised in a patrol sign.

Size, colour and type of patrol sign

3.-(1) A patrol sign shall comprise a roundel and a pole on which the roundel is mounted.

(2) The roundel shall be not less than 430 nor more than 470 millimetres in diameter and each of its faces shall be of the size, colour and type shown in the Schedule to these Regulations.

(3) A red protective non-retroreflecting strip, in these Regulations called a "perimeter strip", may be applied to the perimeter of the roundel so that the visible width of it on either face does not exceed 5 millimetres.

(4) The pole shall be coloured with alternating black and yellow bands of equal size and not less than 285 nor more than 315 millimetres deep with a black band uppermost below the roundel.

5) Regulation 12 (variation of dimensions) of the Traffic Signs Regulations 2002() applies in relation to a patrol sign as it applies in relation to a sign shown in a diagram in Schedules 1 to 12 of these Regulations.

Illumination of patrol signs

4.-(1) The yellow bands on the pole may be illuminated by means of retroreflecting material.

(2) The parts of the roundel coloured black shall not be illuminated by means of retroreflecting material.

(3) Subject to paragraph (4), the parts of the roundel coloured yellow shall be fluorescent.

(4) With the exception of the parts coloured black and the perimeter strip, the roundel shall be illuminated by means of retroreflecting material, but retroreflecting material applied to the parts coloured yellow shall, if that material is not fluorescent, be applied in horizontal strips with gaps between the strips.

(5) The parts of the roundel coloured red (except any perimeter strip) may be fluorescent.

EXPLANATORY NOTE

( This note is not part of the Regulations)

These Regulations prescribe the size, colour and type of the sign which, in accordance with section 28 of the Road Traffic Regulations Act 1984, a school crossing patrol may exhibit so as to require traffic to stop when approaching a place where a person is crossing or seeking to cross a road. The sign was previously prescribed as diagram 605.2 in the Traffic Signs Regulations and General Directions 1994 (S.I. 1994/1519 (revoked by S.I. 2002/ )).
