QUESTIONS

In carrying out this consultation exercise, we hope to receive your views and suggestions on how we should implement the Directive. Throughout this paper, we have asked a number of questions where your response would help in shaping policy. The most important questions are summarised below, under the chapter headings where the issues are dealt with in more detail. A note of the paragraph to which each question refers is also given.

Chapter 3 - River Basin Planning in Scotland

We would like your opinions on how many river basin districts there should be in Scotland. We suggest three strikes the correct balance - do you agree? (para 3.9)

We would also like your views on who should take responsibility for their preparation and implementation and how we involve all interested parties in the River Basin planning process? Your views are also sought on how they will interact with the existing land use planning system? (para 3.2)

We would like your opinions on how far out to sea the River Basin Districts should extend to? We suggest 3nm from the territorial baseline. The area of sea enclosed by the Scottish territorial baseline is already large, therefore our proposals do not extend the Directive's requirements to cover a significantly greater area of water. Do you agree with our approach? (para 3.14)

We believe that it would not be in our best interests to establish a new authority to implement the Directive in Scotland. We seek your views on our proposal that SEPA should be the lead authority in Scotland. (paras 3.17-3.22)

Do you also agree that the lead authority be obliged to consult with and take account of the views of other relevant public authorities involved and that it be required to establish a consultative forum in each River Basin District? Furthermore, do you agree that we should impose a general duty on all public authorities and specific duties where they are relevant? (para 3.24)

We would also be interested in any other views you might have on how we might best secure stakeholder involvement and ownership in the river basin planning process. We need to consider whether there is a role for community planning and what role could new technology play. Finally, do you agree with our proposed role for Scottish Ministers in the River Basin Planning process? (paras 3.29-3.30)

Chapter 4 - Delivering Environmental Improvements

Here we consider whether we can deliver the requirements through existing legislation or whether new controls are necessary. We would be interested in your views of our proposals and, in particular, whether there are any additional means of reducing the regulatory burden. (para 4.14)

Chapter 5 - Control of Point Source Pollution

Your views are sought on whether a unified regime covering the regulation of discharges presently controlled by the Control of Pollution Act 1974 and the Groundwater Regulations 1998 would be an improvement. (para 5.9)

We would also be grateful for your views about the suggestions we make about how the present regime for control of point source pollution could be improved. (paras 5.10-5.12)

Chapter 6 - Control of Diffuse Pollution

We would be grateful for your views on how diffuse pollution would best be tackled. (para 6.9)

Chapter 7 - Abstraction Controls

We seek your views on our proposals for developing a system of abstraction controls. Do you feel there is any scope for taking a different approach than from the one suggested? (para 7.13)

Chapter 8 - The Impoundment Control Regime

We seek your views on our proposals for developing a system of impoundment controls. Do you feel there is any scope for taking a different approach than from the one suggested? (para 8.11)

Chapter 9 - Control Of Engineering Operations

We would like your views on our proposals for developing a system of control of engineering operations. Is there any scope for taking a different approach than from the one suggested? (para 9.15)

Chapter 11 - Monitoring

We believe that in order to co-ordinate the monitoring throughout Scotland required by the Directive, one organisation should be appointed to oversee the process. Do you agree that SEPA should be given this
co-ordinating role?
