THE TOWN AND COUNTRY PLANNING (LIMIT OF ANNUAL VALUE)
(SCOTLAND) ORDER 2001
Introduction
1. This Circular explains the provisions of the Town and
Country Planning (Limit of Annual Value) (Scotland) Order
2001. The Order was made on 23 April 2001 and comes into
force on 1 June 2001.
2. A copy of the Order is enclosed for planning
authorities only.
Background
3. The 2001 Order prescribes £24,725 as the annual value
of the hereditament for the purpose of sections 100 - 122
of the Town and Country Planning (Scotland) Act 1997. Under
those sections, owner-occupiers can, in certain
circumstances, require the appropriate authority to
purchase their interest in property provided that, in the
case of a non-resident owner-occupier, the annual value of
the non-domestic property does not exceed the prescribed
amount.
4. The Town and Country Planning (Limit of Annual Value)
(Scotland) Order 1995 which prescribed a limit of £21,500
is revoked. This Circular supersedes SODD 23/1995 which
accompanied the 1995 Order.
