Repeal of legislation
06/05/2005
The Executive proposes to repeal outdated legislation
dating back to the 19th Century relating to the sale of
methylated spirits.
Views are sought on proposals to revoke Section 26 of
the Revenue Act 1889, which prohibits the sale of
methylated spirits on a Sunday.
It dates back to a time when there was a scheme of
licensing of relevant retailers for excise purposes - this
scheme was removed in the 1960s.
The Methylated Spirits (Sale By Retail) (Scotland) Act
1937 was largely revoked in 1998 - but provisions
prohibiting the sale of methylated spirits to under 14s are
still in force.
All these provisions have been repealed in England and
Wales last year.
It is the intention of the Executive to use the
Licensing (Scotland) Bill to make these changes.
Written responses to the consultation are invited by
August 1.
