Regulations for congestion charging

A series of draft regulations are to be published for consultation which will help set out the legislative framework on how road user charging schemes are to be implemented.

Three sets of regulations are being published today. These relate to:

  • Specifying who would be liable for charges under any charging scheme
  • Procedures relating to how penalty charges will be imposed
  • Ensuring accountability through keeping of accounts and relevant expenses

The consultation period is 12 weeks from today.

The draft regulations published today are titled:

Road User Charging (Liability for Charges) Regulations

Road User Charging (Penalty Charges) Regulations

Road User Charging (Keeping of Accounts and Relevant Expenses) Regulations.

Future draft regulations to be consulted on include the Road User Charging (Enforcement and Adjudication) Regulations and possibly the Road User Charging (Specified Devices) Regulations.

Regulations are published under various sections of the Transport (Scotland) Act 2001 and will apply to any road user charging scheme made under that Act. Under the Act, local authorities have the power to introduce schemes which must be approved by Ministers.
