Strengthening of landfill regulations

The Scottish Parliament today passed amendment
regulations which will result in the existing Landfill
(Scotland) Regulations 2003 becoming more effective in
establishing an improved landfill regime.
The Landfill (Scotland) (Amendment) Regulations 2003
give effect to several changes to the existing Regulations
including:
- The inclusion of Partnerships as entities against
whom action can be taken. (Existing Regulations only
allow for action against individual members of
partnerships.)
- Amending the definition of waste to refer to the
European Waste Catalogue.
This will mean that landfill for a whole range of
wastes, including agricultural waste, will be definitively
covered. In including this amendment we will be adopting
best Europe-wide practice.
Welcoming the passing of the Regulations, Allan Wilson,
Deputy Minister for Environment and Rural Development
said:
"As part of its green agenda, the Executive is
determined to reduce the volumes and manage the disposal of
waste safely. Our landfill regulations act on these
priorities and are an important step in ensuring that the
disposal of waste does not threaten human health or the
environment.
"These amendment regulations will further protect
Scotland's communities from potential environmental
threats, while also providing a transparent regulatory
system for the waste industry."
The Landfill (Scotland) Regulations 2003 came into force
on 11 April 2003. These Regulations were recommended to
Parliament following a debate in the Transport &
Environment Committee on 4 March 2003 and approved on 13
March 2003.
