Crown to appeal against sheriff's beef-on-bone ban decision

The Procurator Fiscal at Selkirk, Mr Duncan MacNeill, has today, on the instructions of Lord Hardie, the Lord Advocate, appealed against the decision of Sheriff Paterson, at Selkirk Sheriff Court on 21 April, to reject charges against Mr James Sutherland for contravention of the Beef Bones Regulation 1997.
The decision to appeal has been made after careful consideration of the Sheriff's decision and the terms of his judgement.
The appeal will be heard in the Appeal Court, Edinburgh at a date to be set by the court.
BACKGROUND
1. To proceed an appeal under statute the Crown had to firstly to be granted leave to appeal.
2. There is no higher court of appeal than the Appeal Court , Edinburgh. The court's judgement is binding on all lower courts in Scotland.
