The Scottish Information Commissioner decided, in December 2006, that the Scottish Executive should disclose information held relating to recommendations to Scottish Ministers and Ministers' subsequent decisions regarding two planning applications notified to them by Stirling Council. The Scottish Executive lodged an appeal against that decision with the Court of Session.

Having given further consideration to the request for information, particularly in the light of the Scottish Government's determination to improve understanding of the reasons for planning decisions, the Government has decided not to continue to pursue its appeal to the Court. Therefore, the information requested, including that required by the Scottish Information Commissioner to be released, is now published and is available from the above links.
